The Background

Acquisition by Barnsley Council of Land on the West Side of Laird's Way, Penistone

We believe Barnsley Metropolitan Borough Council (The Council) have acted both unlawfully and improperly.

We have, via our solicitors, lodged a valid formal complaint and called upon the Council to put in place an Independent Investigation.


To date the Council have refused to investigate what we believe to be a very serious matter.  We also believe that its actions will undermine public faith in the fairness of the planning system as well as the Council's role as a decision maker, following its failure to investigate our valid complaint, which is supported by robust evidence.

Considering that both the Council's Planning and Legal Departments, as well as the Leader of the Council (who personally signed the cabinet authorisation to acquire our land) are complicit in this matter, it is essential that a totally independent investigation, by a suitably qualified individual, is put in place.

The S106 identifies the Sustainable Travel Contribution.  It defines the amount, but not where it should be spent.  It just puzzles me how they didn't read the S106 properly before writing/sending the response... especially when it's such a serious matter
